BAIL APPLN. 4542/2024 By way of the present petition filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks interim bail for a period of 15 days in case FIR No. 85/2021 dated 16.03.2021 registered under sections 302/34 of the Indian Penal Code, 1860 at P.S.: Paschim Vihar West, Delhi, on the ground that his real sister is getting married on 14.12.2024 and being the only brother, his presence at the wedding ceremonies is necessary. 2.

Hazari Courts, Delhi, on the ground that his other sister was getting engaged. Counsel submits, that the petitioner availed the said interim bail and surrendered on time and there is no allegation that he has misused the liberty so granted.

Mr. Tarang Srivastava, learned APP appears on behalf of the State on advance copy accepts notice; and hands-up a copy of Status Report dated 09.12.2024, whereby the Investigating Officer has verified, based on the statements of the petitioner's father and neighbours, that the marriage of the petitioner's sister, viz. Pooja, is scheduled on 14.12.2024. The I.O. has further verified the wedding card, a copy of which is annexed to the present petition.

In view of the foregoing and considering the ground on which interim bail is sought, which ground stands verified by the I.O. vide Status Report dated 09.12.2024, the petitioner - Pradeep Kohli s/o Mahender - is granted interim bail from 11.12.2024 to 15.12.2024, subject to the following conditions :

6.1. The petitioner shall furnish a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the learned Trial Court;

6.2. The petitioner shall not leave the State of Delhi without permission of the court and shall ordinarily reside at the address mentioned in the application;

6.3. The petitioner shall furnish to the Investigating Officer/S.H.O P.S.: Paschim Vihar West, Delhi a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times; 6.4. If the petitioner has a passport, he shall surrender the same to the learned Trial Court and shall not travel out of the country without prior permission of the learned Trial Court; 6.5. The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial. 6.6. Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent.

Nothing in this order shall be construed as an expression of opinion on the merits of the pending matter.

A copy of this order be sent to the concerned Jail Superintendent forthwith.

The petition stands disposed-of.
