IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.REV.P.(MAT.) 502/2025 & CRL.M.A.
33906/2025, CRL.M.A. 33907/2025 SAURABH SURI .....Petitioner Through:
Mr. Amit Gaba, Adv.
versus MEGHA SURI .....Respondent Through:
CORAM:
HON'BLE MR. JUSTICE AMIT MAHAJAN
O R D E R
% 17.11.2025 1.
The Petitioner challenges the order dated 14.08.2025, passed by the learned Family Court, directing the petitioner to pay ad- interim maintenance of ₹10,000/- per month to the respondent.
2.
Undisputedly, the application seeking interim maintenance is still pending before the learned Trial Court. The order on adinterim maintenance was passed by the learned Trial Court considering the emergent need of the wife for securing the maintenance amount as it was submitted that she has no source of income and is not gainfully employed.
3.
In the present case, it has not been disputed that the respondent is the wife of the petitioner herein and the petitioner is working with Tata Consultancy Services and is stated to be earning monthly salary of ₹57,306/-as per salary slip of December, 2024.
4.
Clearly, the impugned order is only an ad-interim order. It The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 20/11/2025 at 11:45:40
is not disputed that the application for relief of interim maintenance is still pending consideration before the learned Family Court. In such circumstances, any petition under Section 397 of Cr.P.C., challenging the interlocutory order would not be maintainable at this stage.
5.
In above circumstances, I find not infirmity in the order passed by the learned Family Court granting ad-interim maintenance of ₹10,000/- per month.
6.
The petition is, therefore, dismissed. Pending applications, if any, also stand disposed of.
