This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "(i) Pass a writ of mandamus or any other appropriate writ, order or direction thereby directing the Respondent to allot a plot in pursuance of the Application moved by the Petitioner bearing Application No.43604 under Rohini Residential Scheme 1981, EWS/Janta category on 23.03.1981;
(ii) Pass an appropriate writ, order or direction thereby directing holding of enquiry for delay in allotment of plot under EWS/Janta category as the persons junior to the Petitioner have been allotted the plots in the year 20 12;
(iii) Pass an appropriate writ, order or direction thereby directing the Respondent to pay compensation to the Petitioner for causing delay of such a long period in allotting the plot to the Petitioner, as this Hon'ble Court may deem fit and proper;
(iv) Award costs of the present Writ Petition in favour of the Petitioner and against the Respondent."

It is the case of the Petitioner that he applied for allotment of a plot under EWS/Janta Category in Rohini Residential Scheme, 1981 on 23.03.1981. The application was received in the office of DDA and was given Priority No. 2727 after the application was registered against Number 43604. On 03.10.1988, Petitioner submitted an application for change of address.

It is averred that on 17.04.1990, Petitioner received a letter from DDA informing that plot No. 104, Pocket-10, Sector 21, Rohini Residential Scheme was allotted under Scheduled Caste Category albeit Petitioner had applied under General Category in the EWS/Janta Category. Petitioner made several attempts to clear the confusion but to no avail. On 12.06.2012, DDA carried out a draw of plots concerning applications under EWS/Janta Category and persons with low Priority Nos. 2726 and 2728 allotted the plots, whereas Petitioner is awaiting his allotment since 1981. 4.

Mr. Sanjay Katyal, learned Standing Counsel accepts notice on behalf of the Respondent and on instructions, submits that the file containing the documents pertaining to the alleged allotment in favour of the Petitioner is untraceable, however, if Petitioner resubmits the requisite documents, DDA will re-examine the matter.

Heard learned counsels for the parties.

Considering the stand of DDA that the file pertaining to allotment of plot to the Petitioner is untraceable and that DDA is willing to reconsider the issue, at this stage, the writ petition is disposed of without entering into the merits of the case, directing DDA to consider the present writ petition as a representation and take a decision looking into the averments therein as also The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
the documents appended to the writ petition, which prima facie do reflect that allotment was made in favour of the Petitioner and contained details which will enable DDA to take a considered decision. The decision shall be taken within 10 days from today and communicated to the Petitioner within two days from the date of the decision.

Needless to state that if Petitioner is aggrieved by the decision of DDA, he will be at liberty to take recourse to appropriate remedies, in accordance with law.
