By way of the present applications filed under Section 5 of the Limitation Act, 1963, the Applicant/Petitioner seeks condonation of delay of 15 days in re-filing the present Petition. 2.

For the sufficient reasons stated in the application, the delay is condoned.

Accordingly, the present application stands disposed of. W.P.(C) 17406/2025, CM APPLs.71937/2025 (for stay), 71938/2025 (for exemption) & 71939/2025 (for exemption) W.P.(C) 17407/2025, CM APPLs.71943/2025 (for stay), 71944/2025 (for exemption) & 71945/2025 (for exemption) 4.

These two connected Writ Petitions, under Article 226 of the Constitution of India, in substance pray for a direction to the learned Debt Recovery Appellate Tribunal1, Kolkata, to decide the Petitioner's Appeals, being Miscellaneous Appeal Nos. 148/2025 and 29/2025, assailing the Interlocutory Order dated 28.05.2025 and the Interim Order dated 21.01.2025, respectively, passed by the learned Debts Recovery Tribunal-III2, New Delhi, in a time-bound manner. 5.

Learned counsel for the Petitioner submits that the Chairperson, learned DRAT, Delhi demitted the Office on 11.08.2025 and no Chairperson has been appointed as yet. On the intervention of the Court, the Chairperson, learned DRAT, Kolkata has been given additional charge of discharging judicial functions of learned DRAT, New Delhi.

In absence of complete information about the total pendency of Appeals or matters before learned DRAT, Kolkata, it will not be appropriate to issue any directions, however, the Petitioner, if so advised, may file an application for early disposal of his Appeals before the learned DRAT, Kolkata, which shall be considered sympathetically by the Chairperson.

With these observations, the present Writ Petitions along with pending applications stand disposed of.
