% 17.05.2017 I.A. 6061/2017 in CS(COMM) 184/2016 Learned counsel for parties state that the matter has been amicably resolved between the parties in accordance with the Settlement dated 10th February, 2017 executed before the Delhi High Court Mediation and Conciliation Centre.

In view of the aforesaid settlement, learned counsel for plaintiff wishes to withdraw the present suit. He also clarifies that the application being I.A. 6061/2017 has been wrongly filed under Order 23 Rule 3 CPC. He states that the same be treated as having been filed under Order 23 Rule 1 CPC.

In view of the aforesaid statement, present suit and pending applications are dismissed as withdrawn.

Since the present matter has been settled before the Delhi High Court

Mediation and Conciliation Centre, Registry of this Court is directed to issue a certificate authorising the plaintiff-company to receive back from the Collector half the amount of the Court-fee paid by it in respect of the present suit.

The next date of hearing is cancelled.
