O R D E R

% 23.03.2018 Learned counsel for the petitioner submits that there is nothing against the petitioner except the disclosure statement of co-accused. Petitioner has nothing to do with the present FIR.

Learned APP has opposed the grant of anticipatory bail to the petitioner. It is contended that petitioner has been named by the co-accused. Petitioner avoided to participate in the investigation. He has been declared PO, inasmuch as, he is involved in three other cases. Learned counsel for the petitioner submits that complainant has also told the Investigating Officer that petitioner was not amongst the persons who had robbed him.

Complainant, who is present in Court, submits that petitioner was

known to him and he had not come with the persons who had robbed him. Keeping in mind the totality of the facts and circumstances, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of `20,000/- with one surety in the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station. However, petitioner shall cooperate in the investigation and appear before the Investigating Officer as and when he is called upon to do so.

Bail application is disposed of in the above terms. Dasti.
