1. It is not in dispute that subsequent to the orders passed by this Court on 13th April, 2018, the following order dated 18th July, 2018 was passed:

"Mr. Amar Pandey, Advocate has entered appearance on behalf of the respondent and submits that he will be filing his vakalatnama during the course of the day. He further submits that his counter affidavit is ready and that the same would be filed in the Registry during the course of the day. Advance copy thereof is served on the learned counsel for the petitioners, who may file rejoinder thereto within four weeks.

Learned counsel for the petitioners submits that in terms of order dated 13.04.2018 they have deposited a sum of Rs.3,42,437/- towards the wages of the respondent for the period of 05.09.2016 to 30.11.2017.

Re-notify on 17.09.2018."

2. The counsel for the Respondent does not dispute that he has now W.P. (C) 3658/2018 Page 1 of 2

received the salary between 5th September, 2016 upto 30th November, 2017. He has also challenged his termination order in separate proceedings.

3. It will be open to the Respondent to urge his entitlement to wages between 1st December, 2017 and 28th February, 2018, in those proceedings in accordance with law. No further orders are called for.

4. The present petition is disposed of in the above terms.

5. The question of law raised, is left open for consideration in the appropriate proceedings.
