O R D E R

% 23.03.2018 Vide the present application, the applicant seeks grant of anticipatory bail submitting to the effect that he has been falsely implicated in the instant case and he was not present at the relevant time. As per the averments made in the FIR, the applicant is alleged to have taken away the mobile phone belonging to the complainant after it was taken away by co-accused to subsequently hand over to another co-accused. It has also been submitted through the averments in the petition that two other co-accused are on bail in the instant case. It has been submitted on behalf of the applicant that the recovery of the mobile and other property has also been effected, which is also affirmed by the Investigating Agency.

In reply to a specific Court query, it has been informed on behalf of the State that there are no previous adverse antecedents against the applicant and that the applicant is aged about 21 years.

Taking into account the totality of the circumstance of the case, in the event of arrest, the applicant is allowed to be released on bail on his furnishing a bail bond of Rs. 50,000/- with one surety of the like amount to the satisfaction of the learned trial Court with directions that he shall not leave the country, shall join the investigation as and when required, shall not tamper with the evidence and shall commit no offence whatsoever. In the event of any further Kalandra or any FIR being registered against the applicant, the State shall bring it to the notice of the Court. ANU MALHOTRA, J MARCH 23, 2018 vm
