The present revision petition is directed against an order of the Trial Court dated 06.09.2025, by which the petitioner [plaintiff in the suit], was refused leave to sue as an indigent person. 4.

The proviso to Section 115(1) of the Code of Civil Procedure, 1908 ["CPC"] provides that revision can be exercised only in a case where the order, if made in favour of the revisionist, would have led to the disposal of the suit or other proceedings. proceeded on merits. Accordingly, the requirement of the said proviso is not satisfied.

In view of the above, the present revision petition, is therefore, not maintainable against the impugned order.

Mr. Ram Narayan Singh, learned counsel for the petitioner, seeks permission to withdraw the present revision petition, with liberty to pursue such alternative remedies, as may be available against the impugned order.

In view thereof, the present revision petition, alongwith pending application, stands dismissed as withdrawn, with liberty as aforesaid. 8.

A copy of the order be given dasti under the signature of the Court Master.
