The applicant herein seeks grant of Regular Bail under Sections 483 read with 528 BNSS, Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. He is, presently, facing trial for commission of offences under Sections 304(2)/309(4)/311/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 25 & 27 of Arms Act, 1959 arising out of FIR No.455/2024 dated 27.08.2024, registered as P.S. New Usmanpur.

There are three accused persons who had, allegedly, committed the robbery in question.

The petitioner was arrested on 31.08.2024, and as per the nominal roll placed on record, he is not involved in any other case. 4.

There is one important aspect of the case which cannot be brushed aside. The trial has already begun and the public witnesses, including the complainant, have failed to identify any of the alleged robbers. The applicant is stated to be 23 years of age, in prime of his youth, with career ahead of him.

Keeping in mind the overall facts of the case, applicant is directed to be released on bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate.

The application stands disposed of in aforesaid terms. 8.
