This petition has been filed by the petitioners namely Kartik Dhaniya, the son and Bhagvati Devi, the mother of the deceased employee seeking compassionate appointment and also educational expenses on the death of his/her father/son respectively. The appointment is being claimed by the son/Kartik Dhaniya.

We have been informed that even respondent no. 4 has submitted an application for appointment on compassionate grounds. Though, no reply has been filed by respondent nos. 1 to 3, appropriate be that the respondents shall decide both the applications keeping in view the Rules and any other factor which according to them will be material for a decision on the application for compassionate appointment within six weeks from today. 3.

Dhaniya who shall be entitled to the compassionate appointment, in view of the order passed by this Court in W.P.(C) 5019/2019 granting to the petitioner half share of pension till 25 years only, resulting in respondent no. 4 getting full family pension, (subject to the Rules). He also states that the petitioner no. 1, Kartik Dhaniya is looking after his grandmother, who is the mother of the deceased employee.

On the other hand, learned counsel for respondent no. 4 states that the submissions made by the counsel for the petitioners shall not have a bearing on the consideration of the request for grant of compassionate appointment in favour of Kartik Dhaniya. We say nothing on the submissions made, as it is for the competent authority to decide the applications in accordance with Rules, and the facts.

Insofar as the grant of educational expenses is concerned, the respondent nos. 1 to 3 shall consider the same and pass reasoned order within eight weeks.
