% 20.11.2019 I.A. 16229/2019 This is a joint application filed by the parties under Order 23 Rule 3 with the following prayers:

"It is most respectfully prayed that this Hon'ble Court may be pleased to:

(a) Dismiss the present Suit as withdrawn in terms of the Settlement Agreement dated 17.10.2019; and/or (b) Pass any other order(s) which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case."

Learned counsel for the parties state that the parties shall abide by the terms of the settlement agreement dated October 17, 2019. The statement is taken on record. Mr. S.C. Singhal, learned counsel for the plaintiffs wishes

to withdraw the suit. The suit is dismissed as withdrawn. In view of the stipulation 6(e) of the settlement agreement dated October 17, 2019, the plaintiffs shall be entitled to refund of 1/4th of the Court fee as deposited by the plaintiffs.

The date already fixed stands cancelled.
