This petition is filed seeking direction to the respondent/bank to release the retiral benefits to the petitioner under Pension Regulations, 1995. 2.

The brief facts are that the petitioner joined the service with the respondent on 23.05.1978 and served for 36 years, 3 months and 24 days. The termination of the petitioner in 1996 was challenged by filing W.P.(C) No.7897/2009. The writ petition was allowed on 04.08.2022 and the respondent was directed to reinstate the petitioner with continuity of service on notional basis. The petitioner by sending emails in the year 2022 and 2023 requested for release of pensionary benefits and salary dues for a period from June, 1994 to November, 1996 and other retiral benefits. On 15.06.2023, the respondent credited provident fund into the account of the petitioner.

The grievance raised in this petition is that the petitioner is entitled to pension and the provident fund has been wrongly credited into the account The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Without commenting upon the merits of the case, this writ petition is disposed of with liberty to the petitioner to file a detailed representation to the respondent within six weeks from today. In the eventuality of the representation being filed, the same shall be considered by the respondent in accordance with law expeditiously.

Considering that the matter involves the release of retiral benefits, let needful be done by the respondent within eight weeks of receipt of the representation.

Needless to say that the petitioner shall be at liberty to avail remedies in accordance with law if aggrieved of the decision.
