Learned senior counsel for the plaintiff states that plaintiff has received an email from defendant no. 1 confirming that the infringing links have been taken down.

He states that plaintiff has also verified the said fact and is satisfied with the action taken by defendant no. 1.

He states that he has instructions to state that in view of the fact that suit has now been decreed qua defendant nos. 1 to 4, the present suit proceedings be finally disposed of.

The suit is accordingly disposed of.

Refund of Court Fees 5.

since the suit has been disposed of at the initial stage even prior to any defendant filing written statement, the Court may consider granting of partial refund of the court fee.

Keeping in view the aforesaid facts, the registry is directed to refund 50% Court Fee in favour of plaintiffs within four (4) weeks, in accordance with law. The said direction has been passed having regard to Sections 16 and 16A of the Court Fees Act, 1870.
