Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of the Complaint and to challenge the summoning Order dated 07.10.2022 whereby the Petitioner has been summoned under Section 138 NI Act. 2.
The basic ground on which the summoning Order has been challenged is that the Petitioner is neither the signatory nor in any way involved in issuance of cheque for which the Complaint has been filed against the husband.

Essentially, it is the summoning Order which has been challenged on merits.

Learned Counsel for the Petitioner submits that the Petitioner is suffering from Cancer, he may be exempted from physical appearance before the learned Trial Court.

The Petitioner is at liberty to move the appropriate Application before the learned Trial Court to seek exemption.
