This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "a). Issue a writ of Mandamus or any other appropriate writ, order or direction to quash and set aside the impugned Speaking Order dated 19.08.2025 and the appellate/DAMC order dated 30.08.2025 (bearing signatures dated 29.08.2025), passed by Respondent No. 3 cancelling the admission of the minor child, declaring the same as arbitrary, illegal, mechanical, and violative of Article 21-A of the Constitution of India and the mandate of the RTE Act, 2009.

b). Issue a writ of Mandamus or any other appropriate writ, order or direction directing the Respondents to forthwith grant/restore admission to the minor child, Baby Gavya, in the allotted school, i.e., ST.ANDREWS SCOTS SR.SEC. SCHOOL, 9th Avenue ,I.P. Extn.,Patparganj, -110092, under the EWS quota for the academic session 2025-26, notwithstanding the impugned orders or the so-called appellate proceedings, so that the child's education may commence without further delay." Mr. Dhruv Rohatgi, learned counsel for GNCTD fairly submits on instructions that the documents submitted by Smt. Asha Devi, legal guardian of Ms. Gavya have been found to be in order and there is no impediment in the writ petition being allowed in her favour. 3.

Accordingly, the writ petition is allowed quashing speaking order dated 19.08.2025 as also order dated 30.08.2025 passed by DAMC. Direction is issued to the Respondents to admit Ms. Gavya, daughter of Mr. Neeraj Gupta and Ms. Renu Gupta registered under registration ID 20250156642 in St. Andrews Scots Senior Secondary School, 9th Avenue, I.P. Extension, Patparganj, Delhi, under the EWS Category. All necessary formalities for admission will be completed by Respondent No.4 and it shall be ensured that the child is made to undergo all activities/classes that have been missed out owing to the delay in admission due to pendency of the writ petition.
