Vide order dated 23.09.2025, the division bench of this Court has passed the following order.

"1. The present Appeal has been preferred under Section 10 of the Delhi High Court Act, 1966, assailing the Judgment dated 17.01.2023 passed by the learned Single Judge in CS (OS) No. 1587 of 2011, whereby the application filed by the Appellants under Order XII Rule 6 of the Code of Civil Procedure, 1908, was dismissed. 2.

Learned counsel for the Appellant submits that pursuant to the order passed by the Hon'ble Supreme Court on 17.09.2025 in C.A. No. 11906-011907/20251 titled as "M/S Caravan Commercial Company v. Yashashwi Aggarwal and Ors.", a settlement has been recorded between the parties, and he has instructions to withdraw the present Appeal.

Learned counsel for the Appellant further states that he has instructions to withdraw the suit as well.

Considering the said submissions, the leave is granted. Accordingly, the Appeal is disposed of, as withdrawn. 5.
