Petitioner has assailed order dated 17.10.2025 of the learned trial court. It appears that the impugned order is a purely procedural order which cannot be interfered with by exercising jurisdiction under Article 227 of Constitution of India.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition with liberty to request the trial court to take up the petition under Section 34 Arbitration and Conciliation Act also along with consideration of stay application. 3.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought. As requested, copy of this order be given dasti.
