Petitioner has assailed orders dated 20.08.2025, 09.10.2025 and 30.10.2025 of the learned execution court. It appears that subsequent to attachment, the subject property was even sold away by way of auction. Learned counsel for petitioner also submits in all fairness that vide order dated 15.11.2025, the execution petition has been disposed of as satisfied. 2.

After addressing partly, learned counsel for petitioner, on instructions, seeks permission to withdraw this petition with liberty to raise same grounds as raised in the present petition by way of a suit seeking appropriate relief. 3.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
