Petitioner/plaintiff has assailed order dated 19.11.2024 of the learned trial court, whereby application of petitioner/plaintiff under Order I Rule 10 CPC seeking impleadment of Modern Public School as co-plaintiff was dismissed on the ground that the said application was not filed by the School and the limitation available to the School to file such suit for damages already stood expired. Even the present petition is stale insofar as there is no explanation for challenging the impugned order after one year. 2.

After addressing partly, learned counsel for petitioner/plaintiff seeks permission to withdraw this petition unconditionally. 3.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn.
