Petitioner has assailed order dated 16.09.2025 of the learned commercial court, whereby application of petitioner/defendant under Order VII Rule 10 CPC was dismissed. After addressing partly, learned counsel for petitioner/defendant on instructions seeks permission to withdraw this petition with liberty to raise the same grounds as raised in this petition before the trial court, which is stated to be listed at the stage of defendant's evidence.
