O R D E R

% 11.03.2015 This writ petition is directed against the decision dated 17.12.2014 rejecting the petitioner's request for permission to sell/ export the subject aircraft pending adjudication. The said order indicates that it is a clear rejection. We feel that the Adjudicating Authority/Competent Authority could have considered the request subject to imposing conditions which fully secure the interest of the revenue.

In these circumstances, we remit the matter to the Adjudicating Authority/Competent Authority to re-consider the request of the petitioner for permission to sell/ export the subject aircraft on imposition of conditions so as to fully secure the interests of the revenue.

The fresh decision may be taken by the

Adjudicating Authority/Competent Authority within one week from today. The petitioner shall file a fresh representation making the request within one day. This petitions stands disposed of.
