O R D E R

The present petition is filed against the order dated 15.10.2025 passed by the learned Principal District & Sessions Judge, North West District, Rohini Courts, Delhi in SC No. 555/2024 whereby the application filed by the petitioner seeking cancellation of Non Bailable Warrants ('NBWs') issued against him was dismissed.

The petitioner was admitted on bail by order dated 26.07.2024 on him furnishing a personal bond in the sum of ₹30,000/- with one surety of the like amount. Certain other conditions were also imposed.

On account of non appearance on behalf of the petitioner before the learned Trial Court on one of the dates, NBWs were issued against him and on the non execution of the same, notice was sent to the surety provided by the petitioner while securing The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Report received by the learned Trial Court indicated that the surety was not found to be residing at the address since he had shifted to some other place.

The learned Trial Court noted that the surety had not informed the Court about him shifting his address and, therefore, the application filed by the petitioner seeking cancellation of NBWs was dismissed.

The petitioner is present in person in the Court today and undertakes that he will not miss any date before the Trial Court unless specifically exempted in that regard. He further undertakes that fresh sureties will be provided within a period of two weeks. 7.

In view of the above, in the opinion of this Court, no purpose would be served by sending the petitioner to judicial custody.

The present petition, purely in the interest of justice, is allowed and the impugned order dated 15.10.2025 is set aside to the extent that the NBWs issued against the petitioner are quashed.

The petitioner is directed to furnish two sureties for a sum of ₹20,000/- each within a period of two weeks before the learned Trial Court.
