% 31.03.2016 Present writ petition has been filed seeking a direction to respondent No.2 to register the sale deed in the name of Mr. Sajjan Kumar Garg with regard to First and Third Floor along with terrace rights of property bearing No.3027A (Old) and 5583 (New), built on Plot No.43 area measuring 42.08 sq.yards, Ward No.VIII out of Khasra No.397/93, 392/305 situated at G.B. Road, Delhi-110006.
Learned counsel for petitioner states that petitioner approached the respondent No.2 for registration of sale deed of the property in question, but the same was denied on the ground that it is a Wakf property. He further states that petitioner enquired from Delhi Wakf Board and he was informed that the property in question is not mentioned in the Wakf Directory and, therefore, it cannot be construed as Wakf property.
Learned counsel for petitioner states that petitioner made a representation dated 20th February, 2016 to respondent No.2 regarding registration of sale deed for the property in question, but no reply has been received till date.
On the other hand, learned counsel for respondents who appears on advance notice states that petitioner has never appeared before the respondent No. 2 and has not filed any sale deed for registration. Keeping in view the aforesaid, present writ petition and application are disposed of with a direction to petitioner to appear before respondent No. 2 on 7th April, 2016 at 11.00 am. along with all relevant papers. Respondent No. 2 is in turn directed to dispose of the petitioner's representation dated 20th February, 2016 by way of a speaking order within two weeks thereafter. This Court clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all parties are left open. Order dasti.
