At the outset, learned CGSC objects to the maintainability of the present petition, on the ground that there exists an arbitration clause in the contract between the parties. He submits that the disputes between the parties are essentially contractual in nature and hence the present petition under Article 226 of the Constitution of India is not maintainable. 4.

Considering the facts and circumstances, and the limited nature of the relief sought, the petition is disposed of with a direction to the Assistant Commandant (Proc), Directorate General, CISF, Block-13, CGO Complex, Lodhi Road, New Delhi, to decide the aforesaid representation after affording an opportunity of hearing to the petitioner, and by way of a reasoned order. The concerned authority is directed to consider the facts and circumstances set out in the petition and the peculiar hardships emphasised by the petitioner.

Till the aforesaid representation is decided, no coercive/ precipitative steps shall be taken against the petitioner.

It is clarified that this order shall not be construed as an expression of opinion of this Court as regards the merits of the controversy. The concerned authority shall take an independent decision in this matter. 8.
