The present petition has been filed under Section 528 of BNSS against the impugned order dated 20.11.2024 whereby the sentence of the petitioner under Section 138 of NI Act has been suspended, subject to the payment of 20% of the compensation amount of Rs. 14,00,000/- which comes to Rs. 2.80 lacs, within a period of 15 months. 4.

The learned counsel for the petitioner submits that he is confining his prayer only for extension of time to make the payment of 20% of the compensation amount. He urges the Court that 60 days time may be granted to make the payment of Rs. 2.80 lacs.

Having regard to the limited prayer sought, issue notice. of the respondent. Likewise respondent has also joined through VC. 6.

On a query posed by the Court, the respondent submits that he has no objection in case the period of 60 days is granted to the present petitioner. 7.

In view of the above, the present petition is disposed of with a direction that the petitioner will deposit 20% of the compensation amount of Rs. 14 lacs (i.e. Rs. 2.80 lacs) with the learned Trial Court within a period of 60 days from today.
