This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "a. Issue a Writ of Mandamus for Passing an Appropriate Order Directing the Respondent to Change the Name of Examining and Affiliating Body of The Petitioner Institute from Uttarakhand Board of Technical Education to Phonics University, Roorkee; b. Such other and further order which this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the present case may also be passed in favour of the petitioner."

Mr. Ajay Kumar Singh, learned counsel appearing on behalf of the Respondent/PCI on advance copy of the writ petition submits that this writ petition is premature inasmuch as Petitioner has not applied to the Pharmacy Council of India under Section 12(2) of the Pharmacy Act, 1948 ('1948 Act'), for approval.

Learned counsel for the Petitioner, on instructions, seeks to withdraw this writ petition with liberty to take recourse to the procedure under Section 12(2) of 1948 Act albeit he submits that on many occasions it is found that the portal of PCI is either not working or not accessible. 4.

This writ petition is accordingly disposed of as withdrawn, with liberty to the Petitioner, as prayed for. Needless to state that if Petitioner applies under Section 12(2) of 1948 Act, the application will be considered by PCI, in accordance with law and in case Petitioner finds any difficulty in accessing the portal, the same shall be brought to the notice of Registrar, PCI, who will take necessary action to ensure that the application is submitted. It is made clear that this Court has not expressed any opinion on the merits of the case.
