The present writ petition has been filed praying for directions to the Municipal Corporation of Delhi (MCD), to proceed with the application filed by the petitioner for the sanction of a Building Plan in respect of property bearing House No. C-100, Anand Niketan, New Delhi, measuring 423.20 square yards, without requiring a "no objection certificate" of the coowner, i.e. respondent no. 2. 2.

Notice was issued in the present writ petition on 19th January 2025, while directing that if any objections are raised by the respondent no.1/MCD in the application for the sanction of Building Plan, the petitioner may make W.P.(C) 17599/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. good those deficiencies.

In the affidavit filed on behalf of the respondent no.1/MCD, it is stated that the deficiencies in the Building Plan were communicated to the petitioner's architect on 3rd November 2025. However, the same have not been removed in a timely manner. Accordingly, the Building Plan of the subject property has been deemed to be rejected on 3rd December 2025. 4.

Counsel for the petitioner submits that mediation proceedings are ongoing between the petitioner and respondent no.2. 5.

In view thereof, the present writ petition is disposed of while giving liberty to the petitioner to file a fresh application for the sanction of the Building Plan.
