The Petitioner's application for parole, forwarded on 17th October, 2025 by his wife and pairokar, was received by the State on 21st October, 2025 and remains pending consideration, compelling the Petitioner to institute the present petition.

Mr. Sanjeev Bhandari, learned ASC for the State, submits that the Petitioner's request was addressed directly to the Deputy Secretary (Home), Government of NCT of Delhi, in contravention of Rule 1213 of the Delhi Prison Rules. Owing to this procedural irregularity, the application could not be processed.

In light of the foregoing, without going to the merits of the case, the present petition is disposed of with a direction to the Respondent to consider and decide the Petitioner's application within a period of two weeks from today. All rights and contentions of the parties are kept open.
