The Appellant assails the correctness of the order dated 28.09.2024 [hereinafter referred to as „Impugned Order‟] passed by the Family Court, whereby the Plaint is retuned to the Plaintiff in exercise of power under Order VII Rule 10 of the Code of Civil Procedure, 1908.

The Appellant has filed Civil Suit No. 77/2023 before the Family Court for grant of decree of declaration and mandatory injunction.

The correctness of the Impugned Order was challenged through the present Appeal.

permission to withdraw the present Appeal in terms of Settlement Agreement dated 26.09.2025 read with Settlement Agreement dated 22.11.2025 executed between the Appellant and Respondent No. 1. 5.
