By the present petition, the petitioner seeks direction to Respondent No. 2 to conduct trial of Respondent Nos. 4, 5, 6 & 7 as adult under Section 18(3) of the Juvenile Justice (Care and Protection of Children) Act, 2015 ('JJ Act') in FIR No. 172/2024 dated 22.02.2024, registered at Police Station Raj Park, for offence under Sections 307/34 of the Indian Penal Code, 1860.

The petitioner is the mother of the victim. She claims that Respondent Nos. 4, 5, 6 & 7 have committed a heinous crime and pursuant to registration of the FIR also, their conduct clearly indicates that they should have been tried as adult. 3.

Undisputedly, preliminary assessment into the heinousness of the offence was done by the learned Juvenile Justice Board in terms of Section 15 of the JJ Act. thereof, has already passed an order dated 31.01.2025. 4.

Even though the order dated 31.01.2025 is not on record, however, on being asked, it is informed by the learned counsel for the petitioner that the learned Board has not held that there is a need for the trial of Respondent Nos. 4, 5, 6 & 7 as adult. 5.

Concededly, the order passed by the learned Board is appealable in terms of Section 101 of the JJ Act. The appeal, if any, against the order passed by the learned Board would lie before the learned Court of Sessions.

Considering the above, the learned counsel for the petitioner seeks liberty to withdraw the present petition and file an appropriate appeal before the learned Court of Sessions. 7.

The present petition is dismissed as withdrawn with the aforesaid liberty.
