The present application has been filed by the petitioner for modification of the order dated 27th November, 2025 passed by this Court, whereby, the present petition had been dismissed by the Court. 4.

Learned counsel appearing for the petitioner submits that the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

petitioner herein had been allotted a Catering Stall/Special Minor Unit ("SMU") (reserved for OBCs) No. CS-2, Near OHE Pole No. 228/15, at Platform No. 1 of Sant Hirdaram Nagar Railway Station, Bhopal Division. 5.

It is submitted that the present writ petition had been preferred by the petitioner praying for extension of 7 months for the purposes of vacation of the SMU in question, in parity with other persons, who had been granted such relief. It is submitted that the present writ petition was dismissed on 27th November, 2025 on the ground that a successful bidder had already been declared on 19th November, 2025 with respect to the SMU in question. 6.

It is submitted that as per the information of the petitioner, the Railway administration has cancelled the contract/tender of the successful bidder on some technical grounds on 08th December, 2025. Since the SMU in question is lying vacant and has not been allotted to anyone, the petitioner has filed the present application.

Per contra, learned counsel for the respondents submits that a fresh tender with respect to the said SMU has been floated today itself. He has handed over a copy of the document with regard thereto, which is taken on record.

Having heard learned counsels for the parties, this Court takes note of the fact that the petitioner has already vacated the SMU in question. It is to be noted that this Court has been granting 7 months extension to the various petitioners for the purposes of vacating the concerned catering stalls. Once a stall has already been vacated, this Court shall not restore the possession of any person, who was earlier possessed of the same. 9.

This Court further takes note of the submission made on behalf of the Railways that a new tender process has already begun. Accordingly, the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

petitioner is at liberty to participate in the fresh tender process. 10.

Noting the aforesaid, the present application is accordingly disposed of.
