Learned counsel for applicant submits that there is no progress in the matter as the alleged public witnesses have so far not been entered into witness box and the accused is in custody since 30.11.2024.

Learned APP for State submits that the case is fixed for evidence and priority would be given to the examination of material public witnesses. 3.

In view of the above assurance, at this stage, learned counsel for applicant, without prejudice to his rights and contentions, does not press the present application.

Application is, accordingly, disposed of as not pressed. 5.

However, learned Trial Court is also requested to summon the material public witnesses and to make best effort to examine them before any other witness. Needless to say, if any such witness enters the witness box, the defence should also ensure that they are cross-examined without any delay. 6.

Applicant is given liberty to file bail application afresh, once the material public witnesses are examined or if there is any delay in procuring the attendance of public witnesses before the learned Trial Court.
