Writ Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioner, Nand Kishore for quashing of FIR No. 0458/2025 dated 19.09.2025 under Section 75 of Juvenile Justice (Care and Protection of Children) Act, 2015, registered at Police Station Bhajan Pura, Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 20.09.2025.

On advance Notice, learned ASC has appeared and accepted the Notice on behalf of the State.

As per the FIR, the victim, who was a 15-year-old boy, was allegedly beaten up by the Petitioner, who was the teacher in the school. However, it is submitted that the FIR was registered under misunderstanding as the victim had been beaten by his co-students. The rectification Application had been submitted on the next day of registration of FIR. All these facts are narrated in the 'Anapati Patra' (No Objection Letter) on 20.09.2025. 7.
On the Complaint of the Respondent No.2/Complainant, FIR 0458/2025 dated 19.09.2025 under Section 75 of Juvenile Justice (Care and Protection of Children) Act, 2015, got registered at Police Station Bhajan Pura, Delhi.

It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement dated 20.09.2025.

Today, the victim is present with his sister, who was the Complainant and his mother and have been identified by their Counsel and Investigating Officer concerned. They all endorse that the matter has been amicably settled, without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 0458/2025 dated 19.09.2025 under Section 75 of Juvenile Justice (Care and Protection of Children) Act, 2015, registered at Police Station Bhajan Pura, Delhi and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
