In furtherance of last order, today both sides are present. 2.
Learned counsel for petitioner, on instructions of petitioner present in courtroom, seeks permission to withdraw this petition and undertakes that the petitioner shall vacate the subject property on or before 08.02.2026 after clearing all electricity and water charges and also after letting the respondent click pictures/videos of the condition of the subject property at the time of vacation thereof. Learned counsel for respondent, who is accompanied with respondent in person, accepts the request.

As requested, the petition and the accompanying application are dismissed as withdrawn with the directions that the petitioner shall vacate the subject property on or before 08.02.2026 after clearing all electricity and water charges; and that the petitioner shall give in writing 24 hours notice to the respondent as regards the date and time of vacation so that at that time, the respondent may click pictures/videos of the condition of the subject property.

It is made clear that if on or before 08.02.2026, the petitioner does not vacate the subject property, the execution proceedings shall be carried out expeditiously.
