By the present petition, the petitioner seeks following prayers :

a) Issue an appropriate Writ in the nature of "Mandamus" directing the Respondent to decide the application for 2nd spell of furlough within a reasonable time or in alternative direct the Respondent to release the Petitioner on 2nd spell of furlough for the period of 14 days and or;

b) Pass any other or such other further orders as this Hon'ble court may deem fit, just and proper in the facts and circumstances of the case and in the interest of justice.

seeking furlough has not yet been decided by the respondent authorities despite almost eight weeks having elapsed. 3.

The learned counsel for the petitioner submits that in terms of Delhi Prisons Rules, 2018, an application seeking furlough / parole has to be decided within a period of four weeks and the pendency of the same causes grave prejudice to the convict since the convict is only entitled to be released for a fixed period of days during one conviction year.

Considering the above, the respondent authorities are directed to decide the application seeking furlough filed by the petitioner, within a period of two weeks from date. 5.

No further orders are required to be passed in the present petition.

The present petition is allowed in the aforesaid terms. Pending application also stands disposed of.
