% 29.01.2016 CM No.3273/2016 (of the petitioner for correction of the order dated 18th December, 2015) 1.

It is stated that Mr. R.K. Saini, Advocate had not appeared on 18th December, 2015 and only Mr. Atul Guglani, Advocate had appeared on 18th December, 2015. The appearance recorded of Mr. R.K. Saini for the petitioner in the order dated 18th December, 2015 is sought to be deleted. 2.

The order dictated in the Court records what had transpired during the hearing and if Mr. R.K. Saini, Advocate has not appeared, Mr. Atul Guglani, Advocate must have given memo of appearance mentioning the name of Mr. R.K. Saini, Advocate also and on the basis of which memo of appearances the presence are recorded in the ordinary course. No pass-over was sought by Mr. Atul Guglani who had proceeded to argue.

I may however record that the counsel for the respondents has fairly stated that Mr. R.K. Saini, Advocate had not appeared on 18th December, 2015 and arguments were addressed by Mr. Atul Guglani, Advocate only. 4.
