Having heard the respective counsels at length, we appreciate the stand expressed by the counsel appearing for respondent no.1-Municipal Corporation of Delhi, on instructions, that the act of relocating the petitioner shall be kept in abeyance, till the procedure contemplated under the Street Vendors (Protection of Livelihood and Regulations of Street Vending) Act 2014, as also the Delhi Street Vendors Scheme, 2019, in the matter of relocation is taken recourse of.

However, we make it clear that same will not give leverage to petitioners/vendors to conduct the vending activity as per their whims and fancies.

We make it clear that the vendors must follow not only the terms of the vending certificate, but also the provisions of the Act (latest), Street Vendors (Protection of Livelihood and Regulations of Street Vending) Act 2014, as also the Delhi Street Vendors Scheme, 2019. 4.
It is equally required under the law that the vendors who are petitioners before us must respect the traffic rules and restrictions. 5.
We further make it clear that respondents shall be at liberty to take appropriate steps in accordance with law in case if any violation is noticed. 6.
The petitions, accordingly, stand disposed of. 7.
Pending applications stand disposed of.

We make it clear that the respondents are at liberty to follow such procedure, as is contemplated under the above said Act and the Rules in case if they intend to relocate the weekly market/vendors. We clarify that the vending activities shall be strictly in terms of the vending certificate, if held by the petitioners. Such persons who don't hold any vending certificate shall be dealt with in accordance with the law.
