This suit is instituted on behalf of the Plaintiff inter alia for permanent injunction restraining the Defendant and all others acting on its behalf from manufacturing, selling, offering for sale, advertising, trading and marketing etc. biscuits/cookies with identical shape or any shape under the impugned mark LITTLE HEARTS and/or its variants and shapes, amounting to infringement. During the course of the proceedings, parties were referred to the Delhi High Court Mediation and Conciliation Centre, where they have amicably resolved their inter se disputes and Settlement Agreement has been executed between the parties on 01.01.2026. 2.
Learned counsel for the Plaintiff submits that counsel for the Defendant has handed over a Demand Draft dated 16.12.2025 bearing no. 000182 drawn on HDFC Bank in the sum of Rs. 4,00,000/- to counsel for the Plaintiff in terms of paragraph (e) of the Settlement Agreement and suit be decreed in terms of the settlement.

Court has perused the terms of settlement incorporated in the Settlement Agreement, copy of which has been placed on record and finds the same to be lawful. Accordingly, the suit is decreed in terms of the settlement, which shall form a part of the decree and the terms therein shall bind the parties to the settlement.

Registry is directed to draw up the decree sheet. 5.
Suit stands disposed of along with the pending application. 6.
Plaintiff is held entitled to refund of entire court fee in accordance with Court Fees Act, 1870.

This application is filed on behalf of the Plaintiff under Order XXXIX Rule 2A read with Section 151 CPC for disobedience and non-compliance of order dated 11.12.2025.

In light of the settlement, learned counsel for the Plaintiff, on instructions, does not press this application. 9.
Application is disposed of as not pressed.
