This application stands disposed of.

CM(M) 4068/2024 1.

The learned counsel draws the attention of the Court to the order dated 29.10.2024 passed by the learned Civil Judge. 2.

The learned counsel submits that he filed an application under Section 151 CPC for tracing the record of the suit bearing No. 666/2001 for inspection and obtaining certified copies.

The order passed by the learned Civil Judge reveals that the matter was decided in appeal bearing RCA 02/2008 against the judgment passed on 22.10.2009 in CS No. 666/2001 but the file was not received back from the Appellate Court.

The learned Civil Judge dismissed the application as the file had not been received back from the Appellate Court.

The main grievance of learned counsel is that no directions were issued for the purpose of tracing of Court record. 6.

Since Court record was not traceable, it would be more appropriate if the petitioner files an application before the Principal District and Sessions Judge on the administrative side for issuing directions for tracing of the record. Once such an application is filed, it is expected that the learned District Judge would pass the requisite orders. 7.
