The present petition has been filed seeking anticipatory bail in connection with FIR No. 390/2024 under Sections 64(1)/70(1) of BNS, 2023 and Section 4 of POCSO Act, 2012 registered at PS Lajpat Nagar, Delhi. 2.

The case of the prosecution is that complaint was made by the two prosecutrices alleging a gang rape by one person namely, Aman Pal and four other co-accused persons namely,- (i) Shivam; (ii) Ashish @ Anshuman; (iii) Amar Mehra and (iv) Gagan Mehra.

The learned counsel appearing on behalf of the petitioner submits that in the FIR itself it has been mentioned that the present petitioner had left the place before the incident took place.

The learned APP appearing on behalf of the State, on instructions from the IO, submits that the petitioner has joined investigation and his custody is no more required.

He further fairly states that the role of the petitioner is limited and the chargesheet has already been filed.

He further submits that pursuant to the direction given by this Court the prosecutrices was duly intimated by the Investigating Officer with regard to the filing of present bail application, as well as, today's hearing. The statement is taken on record.

In view of the above, it is directed that in the event of petitioner's arrest, he be released on bail subject to his furnishing personal bond in the sum of Rs.25,000/- and a surety bond of the like amount to the satisfaction of the SHO / Arresting Officer and further subject to the following conditions that:- (i) Petitioner shall join investigation as and when directed by the I.O concerned.

(ii) Petitioner shall not influence the witnesses in any manner or try to contact the complainant or tamper with the evidence. 9.

With the aforesaid directions, the petition stands disposed of. 10.
