O R D E R

The present proceedings are instituted on behalf of the petitioner seeking quashing of FIR No. 1386/2021 registered under Section 354 IPC at P.S. Rani Bagh, Delhi on the ground that the parties have amicably settled their disputes.

As per the allegations levelled in the FIR, petitioner mishandled respondent No.2 and inappropriately touched her causing her mental distress.

Learned APP for the State, on instructions, submits that the petitioner is the only accused person and respondent No.2 is the complainant/victim in the present case. compromised, however, since the State machinery has been put in motion and the allegations are of grave nature, some cost may be imposed upon the petitioner.

Learned counsel for the petitioner submits that the petitioner and respondent No. 2 have amicably settled their disputes vide MOU/Settlement Agreement dated 19.11.2024, a copy of which has been placed on record. 5.
It is informed that cross FIR No. 1389/2021 registered under Sections 308/34 IPC at P.S. Rani Bagh on the complaint of petitioner, has also been quashed by this Court vide today's order passed in CRL.M.C. 9403/2024. 6.
Petitioner, who is present in Court, has been identified by his counsel as well as the I.O. Respondent No.2 is also present in Court and identified by the I.O. Petitioner has shown remorse for his conduct and undertakes not to repeat the same in future.

Respondent No. 2 states that she has entered into the settlement with the petitioner out of her own free will, volition and without any coercion. She further states that she has no objection if the present FIR and consequent proceedings are quashed.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed, subject to payment of cost of Rs.10,000/- to be deposited with 'Avlamban Fund Scheme, 2024' (State Bank of India, Tis Hazari Branch, Delhi, Account No. 43599660056; IFSC SBIN0000726 & MICR Code 110002126).

Proof evidencing receipt of deposit shall be filed with the I.O. failing which, the I.O. shall be at liberty to move an appropriate application. 11.
