% 03.04.2018 By this petition, the petitioners seek direction to the respondent to stop harassing the petitioners and to provide security. On a notice being issued a status report has been filed. As per the status report on the complaint of one Chand Mohd., FIR No. 44/2018 under Section 363 IPC has been registered regarding kidnapping of his minor daughter.
The complainant suspected Shahrukh and Tofheek after he received phone call from the girls that is his minor daughter and niece who were missing that they were with two boys, namely, Shahrukh and Tofheek. Shahrukh is son of petitioner No. 1 and Tofheek is nephew of petitioner No.1.
When the CDR of the phone number from which the phone call was W.P.(CRL) 890/2018
received, was analysed, it was revealed that Shahrukh's family members were residing at A-80, Sangam Vihar, Delhi and he was in constant touch with them. Thus to investigate the matter, family members of Shahrukh and Tofheek were summoned.
Considering that FIR has been registered and the petitioners are required to join the investigation, this Court finds no ground to pass any order in favour of the petitioners.
Petition is dismissed.
