O.M.P. (T) (COMM.) 31/2016 & I.A. No.5193/2016 Grievance of the petitioners is that the arbitrator, who was appointed by the respondent in the month of December, 2015, has not commenced the proceedings.
Though there is a valid justification given by the petitioner that more than four months have passed, still the Arbitrator has not commenced the proceedings.
Under these circumstances, the present petition is disposed of with the direction that the learned Arbitrator shall commence the proceedings within two weeks from today. Copy of the order
be sent to the respondent as well as the learned Arbitrator forthwith by the Registry. The Arbitrator will decide the disputes between the parties within the time framed as per the provisions of Arbitration and Conciliation (Amendment) Act, 2015. Dasti.
