% 12.11.2018 In proceedings under Section 138 of The Negotiable Instruments Act, 1881, a contempt reference has been received from the Trial Court, as despite giving an undertaking, accused had not made the payment. As per last order, proceedings under Section 82 & 83 of Cr.P.C. have been initiated against respondent / alleged contemnor. In the facts and circumstances of this case, contempt reference is closed with direction to trial court to proceed further against respondent/ contemnor in proceedings under Section 138 of The Negotiable Instruments Act, 1881, if not already done.
