% 04.05.2016 I.A. No.5558/2016 This application has jointly moved by petitioner nos.1 to 3 and respondent no.2 under Section 104 of the Hindu Succession Act, 1935. The application seeks to record the compromise arrived at between the parties. The application is signed by the parties and their respective counsels and it is also supported by the affidavits of petitioner nos.1 to 3 and respondent no.2. The parties to the settlement are stated to be the only Class-I heirs of the deceased Smt. Satya Mehta.

Under the will in question dated 03.12.1989, different portions of the property in question bearing No.M-15, Green Park Main, New Delhi had been bequeathed to the parties. However, the parties have agreed to jointly

dispose of the property and share the proceeds in the manner as indicated in the settlement.

The terms of the settlement appears to be fair, just and reasonable and I see no impediment in accepting the same, particularly because the parties are the Class I heirs of the deceased. Accordingly, the settlement is accepted and the parties shall remain bound by the same. Petition stands disposed of in the aforesaid terms. VIPIN SANGHI, J MAY 04, 2016 sr
