After brief submissions, the learned counsel for the appellant seeks permission to withdraw the appeal with liberty to approach the objecting Court as certain arguments, which were raised before the Court concerned, are not dealt with in the impugned order.

The learned counsel for the respondent does not have any objection. He says that he will meet the points raised by the appellant at an appropriate stage.

In view of the above said statements the appeal is dismissed as withdrawn with liberty as prayed for.
