% 20.09.2018 The learned counsel for the plaintiff says the liquidation order has been passed against the defendant company on 21.08.2018 and the claim filed with the plaintiff has not been approved and adjudicated by the Resolution Professional despite claim of plaintiff being shown at SI No. 96 in the status of claims filed by Operational Creditors. It is only because the suit is pending before the Court. Hence withdrawl is sought by the learned counsel for the plaintiff while seeking liberty for adjudication of dispute by the Resolution Professional. In view of the above the matter is dismissed as withdrawn with such liberty.

The plaintiff is entitled to refund of Court fee as per the provisions of the Court fee Act.

Copy of this order be given Dasti under signature of the Court Master.
