Heard the learned counsel for the parties.

This intra-Court appeal has been filed against an order dated 23.07.2025 passed by the learned Single Judge in W.P.(C) No. 10275/ 2025. 3.
Ordinarily, a Letters Patent Appeal against an interlocutory order is not maintainable. However, learned counsel for the appellant states that the writ petition itself was not maintainable and, therefore, the interim order dated 23.07.2025 passed by the learned Single Judge could not have been passed. made by the appellant by moving an appropriate application seeking vacation of the interim order dated 23.07.2025. 4.
Learned counsel for the appellant, at this juncture states that the appellant may be permitted to withdraw the appeal with liberty to move an appropriate application before the learned Single Judge seeking vacation of the interim order dated 23.07.2025.

Accordingly, without expressing any opinion as to the merit of the rival submissions of learned counsel for the parties, the appellant is permitted to withdraw the present appeal with liberty to the appellant to move an appropriate application seeking vacation of the interim order dated 23.07.2025.

We provide that all the pleas, including the plea related to the maintainability of the writ petition shall be open to be taken before the learned Single Judge in the proceedings of the pending writ petition. 7.
The appeal stands disposed of.
