These two connected Appeals, instituted under Section 19 of the Family Courts Act, 1984, have been preferred by the Appellant-wife challenging the legality and correctness of the Orders dated 24.04.2024 and 27.10.2025 passed by the learned Judge, Family Court-02, South District, Saket Courts, New Delhi in HMA No.1845/2022, whereby her right to file the Written Statement was closed and the proceedings were directed to continue ex parte against her.

After hearing learned counsel for the parties at length, the following consensus has been arrived at:
i. The Appellant shall file her written statement before the learned Family Court within 10 days, i.e., on or before 02.12.2025, failing which her right to do so shall stand closed. ii. The Respondent-husband may file his rejoinder, if any, within 7 days thereafter, i.e., on or before 09.12.2025, failing which his right to file the rejoinder shall stand closed. iii. Although the Respondent-husband has already filed his affidavit by way of evidence, the learned Family Court shall first cull-out the issues that require adjudication before permitting the parties to lead evidence. The issues shall be culled out within 7 days from the date of filing of the rejoinder. iv. The Respondent shall thereafter file a fresh affidavit in evidence.

v. The evidence of the parties shall be recorded before a Local Commissioner to be appointed by the learned Family Court. vi. The Appellant shall conclude the cross-examination of the Respondent on two consecutive dates before the Local Commissioner, whereafter no further opportunity shall be granted.
vii. The Appellant shall lead her evidence and appear before the learned Family Court for examination within 10 days of the conclusion of the Respondent's evidence.
viii. The Respondent shall similarly be granted only two consecutive opportunities before the Local Commissioner to complete the cross-examination of the Appellant. Upon completion of evidence, the learned Family Court shall make sincere efforts to dispose of the matter expeditiously by passing the final judgment.

With these observations, the present Appeals along with pending applications shall stand disposed of. 4.
